The Constitution of the Free State of Saxony is in Article 88 of the voluntary association of communities take precedence over legal field changes.
The merger of municipalities may, in accordance with § 8 of the Saxon church order (SächsGemO) can be done in two basic forms: either by inclusion (incorporation) of local government to another municipality or by merger of several municipalities (Association).

Which kind of community combination is chosen, has different consequences for the content of the agreement on the territorial change, the continued existence of community institutions, the continued application of local law and, if necessary arises to what extent land transfer tax.
